1. Introduction

The following website and any and all related products and Services (collectively referred to as the “Website”) are operated by SyndiGate Media Inc. and its Affiliated Parties (each of the foregoing entities, and all entities collectively, “SyndiGate” “We,” “Us” or “Our”).

This Privacy Policy (“Policy”) explains how We collect, use and protect information that We learn about Our Users (defined below) (collectively “User”, “You” or “Your”), as a result of Your interaction with Us through any website and any and all related products and Services on which this Policy is posted, including any website You may access using Your mobile electronic device, and the Services defined below.

Affiliated Parties means SyndiGate Media Inc., Al Bawaba Middle East Limited, Al Bawaba FZ-LLC and any related individuals, affiliates, subsidiaries, parents, and any of their trustees, directors, officers, shareholders, employees, representatives, consultants, attorneys, agents, suppliers, distributors, licensees or licensors.

Personal Information means information (which may include sensitive information) relating to a living individual who is or can be identified either from that information or from that information in conjunction with other information that is in, or is likely to come into, Our possession.

Service or Services means any of the websites or other products or services provided or offered by Us, including those described in this Privacy Policy, whether through a website owned, maintained or controlled by Us, through a social network, a mobile application, on a mobile telephone or otherwise.

Third Parties means companies or persons not related by common ownership or control (i.e., non-affiliates) or other unrelated individuals or companies. Third parties can be financial and non-financial companies or persons other than You and SyndiGate Media Inc.  

User means any individual who uses our Services whether that individual does so on his or her own behalf or on behalf of an employer.

BY VISITING OUR WEBSITE, YOU ARE ACCEPTING AND CONSENTING TO THE PRACTICES DESCRIBED IN THIS POLICY, AS UPDATED AND AMENDED FROM TIME TO TIME. IF, FOR ANY REASON, YOU DO NOT AGREE TO THE TERMS OF THIS POLICY, PLEASE DO NOT USE THE WEBSITE, OR IF YOU HAVE STARTED USING IT, STOP USING THE WEBSITE IMMEDIATELY.

This Privacy Policy applies to personal information We collect in connection with Your subscribing to Our Website.  What We collect is discussed below in Section 2.

We may modify this Privacy Policy from time to time so please look at the effective date at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when We post the revised Privacy Policy. By using Our Services or website and by providing personal information to Us, You are also agreeing to any revised terms and conditions of this Privacy Policy.

If there is a conflict between this Policy and any license agreement associated with SyndiGate’s Services, the license agreement will take precedence.

We are not targeted to, and do not knowingly collect personal information from, minors under 18 years of age. We request that these individuals do not provide personal information to Us.

2. Information We Collect.

The information We collect depends on the Services You use and subscribe to.  It includes (but is not limited to):

  • Your name, address, phone number and email address.
  • Credit or debit card information, information about Your bank account number, routing number, IBAN number, sort code or other banking information.
  • Your account information – such as dates of payment owed and received and the subscription Services You select and use, and any other information related to Your account
  • We might also collect other information that does not reveal Your specific identity, such as browser information, Website usage data, information collected through cookies and other technologies, demographic information, and aggregated information.  For more information on cookies, see Section 4.

3. Privacy Policy Details

By accessing any part of the Website, User agrees to the practices described in this Policy and consents to the collection, use and disclosure of User information as set out in this Policy. 

This Policy is effective as of the date set out above. We reserve the right to modify it at any time, and such revisions will become effective upon the earlier of (a) posting of the revisions to the Website, or (b) distribution by electronic mail. User’s continued use of the Website or any of Our Services after the effective date of the revision(s) means User accepts and agrees to any such revisions.

This Policy is applicable only on Our Website or wherever else we may post it as part of our products and Services. Due to the nature of certain of Our Services, You may not find any third-party website or application links on the pages of Our Website.  However, where they are provided, this Policy does not cover the information or privacy practices of any third-party websites, applications or other platforms or software (including any non-affiliated payment processor) that are linked to the Website or that You may otherwise be able to access from the Website.  We do not control, and are not responsible for, any such third-party websites’, applications’ or other platforms’ or software’s collection and use of User information. All Users should refer to the privacy policy disclosures on those websites, applications and other platforms or software to obtain information regarding their information collection and use practices.

There is a variety of information We collect that You provide when You become a User or otherwise communicate with Us. While some of the data may be optional, this information may include the name, address, telephone number and email address, or when any User requests further responses from Us. If You report a problem with Our Website, there may be additional details requested, as well. Also, if You contact Us, We may keep a record of those communications.

We also collect Log Data which is information that is automatically recorded by Our servers whenever You access or use the Website, regardless of whether You have an account with us or logged into Your account, such as Your IP address, the date and time You access or use the Website, the hardware and software You are using, referring and exit pages and URLs, the number of clicks, device event information, pages viewed and the order of those pages, and the amount of time spent on particular pages.  We may also allow Our business partners to use their cookies and other tracking technologies on the Website. As a result, when You access or use the Website, You will provide or make available certain information to Us and to Our business partners.

By accessing or using the Website, User may provide Us with two types of information: (i) “personally-identifiable information” that You are required to disclose to Us, such as the name, address, telephone number and email address (“PII”); and (ii) other information (“non-PII”), which We collect through the use of technologies called “cookies,” “web beacons” and/or “web logs.” We use the information We collect to monitor and analyze how Users use the Website and Our Services, to provide customer service and to maintain and improve Our Services. We may also collect technical information to help Us identify a User’s mobile device or computer.

If You choose not to submit the requested information, You will not be able to access or use some or all of these Services.

The information We collect and Your use of Our Website may be maintained in servers We control and maintain or in third party servers. If Your information changes, You chose to delete Your account with Us, or if You no longer desire any Services, You may correct, amend, update, remove or otherwise change Your information with Us by updating Your profile in Your account or by contacting Us at the contact information listed in Paragraph 12 below.

If You would like to review, correct, update, amend, delete, remove or otherwise revise or limit Our use of any information or data You have provided to Us, You may contact Us as indicated in Paragraph 12 below.

5. Our Security Measures

The information You provide to Us is stored on servers that are located in secured facilities with restricted access and are protected by protocols and procedures designed to ensure reasonable security of such information. In addition, We restrict access to User PII to those of Our employees, independent contractors and agents who need to know this information in order to develop, operate and maintain the Website and Our Services. However, no data transmission over the Internet is completely secure nor can any be guaranteed to be totally secure, and, for this reason, We cannot ensure or warrant the security of any information You transmit to Us. You can help protect Your PII and other information by using a combination of letters, numbers and characters in Your password, changing Your password often, using a secure web browser, and signing off and closing Your web browser and the Website when You are finished with the use of the Website.

6. How We Use and Share Your Information

At this time, We only use Your information for (a) everyday business purposes, such as to process Your transactions, maintain Your accounts, or to respond to court orders and legal investigations and (b) for Our marketing purposes, so as to keep You generally informed about new products and Services and to offer Our products and Services to You.

At this time, We do not share Your information with third-parties or affiliated companies, except to process payments.

As a User, You agree We may disclose information You provided about yourself as a User to Our employees, agents, contractors and sub-contractors, and Our related and affiliated individuals and entities and their respective employees, agents, contractors and sub-contractors, in accordance with applicable law and for the limited purpose of administering the Services We provide.

We store and process information about You for the following general purposes:  

  • to enable You to access and use the Website;
  • to operate, protect, improve and optimize the Website, Our business, and Our Users’ experience, such as to perform analytics, conduct research, personalize or otherwise customize Your experience, and to provide customer service;
  • to help create and maintain a trusted and safer environment on the Website and with Our Services, such as detection and prevention of actual and potential fraud and other harmful activity, conducting investigations and risk assessments, enforcing our Terms and policies, and conducting checks against databases and information sources (such as, but not limited to, public government databases) for fraud detection and prevention, and for risk assessment and harm prevention purposes.   • to administer referral programs, activities or events sponsored or managed by Us or Our Third Party business partners;  and/or
  • to comply with Our legal obligations, resolve any disputes that We may have with any of Our Users, and/or enforce Our agreements with Third Parties.

We will share information, including User PII, with other parties under the following circumstances:

Protection of Rights. We will share User information for the purpose of providing Our Services if We have a good faith belief that: (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation or legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities; (ii) such action is appropriate to enforce Our Terms of Use, including any investigation of potential violations thereof; (iii) such action is necessary to detect, prevent, or otherwise address credit risk, fraud prevention, security or technical issues associated with the Website and/or Our Services; (iv) such action is appropriate to protect Our rights, property or safety or the rights, property or safety of Our employees, Users of the Services or others, (v) if We undertake or are involved in any merger, acquisition, reorganization, sale of assets or bankruptcy or insolvency event, then We may sell, transfer or share some or all of Our assets, which may include Your Personal Information. In this event, We will notify You before Your Personal Information or that of any current or former employees is transferred and becomes subject to a different privacy policy.

We may share User PII with the service providers that We engage in connection with the Services and/or the Website.

You may review, update, correct or delete any Personal Information related to Your account. If You would like to correct any information or cancel Your account entirely, You can do so by logging in to Your account.

Please do not share sensitive information with Us unless absolutely necessary and then do so in the most secure manner possible.

7. Choices and Access

You may opt-out from receiving electronic communications from Us by following the unsubscribe instructions at the bottom of the relevant email.

You can access, review, correct, update, delete or modify Your registration or subscription profile information, including Your personal information, and modify Your marketing preferences by contacting Our Customer Service at the phone number and email address set forth in Section 12 below.

You can also write Us at any time to get a copy of the personal information We hold about You.  To make such a request, please write to Us at the email address set forth in Section 12 below and include Your name and the email address to which You would like Us to respond.

For Your protection, We may only implement requests with respect to Your personal information if sent from the particular email address associated with Your account and We may need to verify Your identity before implementing Your request. We will try to comply with Your request as soon as reasonably practicable.

We will retain Your registration and subscription information for as long as Your account is active or as needed to provide You services unless a longer retention period is required or allowed by law and our legitimate interest.  Please note that We may also need to retain certain information for recordkeeping purposes and/or to complete any transactions that You began prior to requesting such change or deletion (e.g., when You make a purchase, You may not be able to change or delete the personal information provided until after the completion of such purchase).

8. Tracking policy

 You may be able to adjust Your browser’s settings to turn on a “do not track” feature. Although Our policy may change in the future, currently, We do not support “do not track” and will not honor Your web browser’s “do not track” signal.

We do not participate in tracking networks and do not intentionally or knowingly allow other parties to collect information about Your on-line activities over time and across different websites, applications or other platforms, when You visit the Website or use any of the Services.

Among the additional uses We may make of the data We have from and about You, We may:

 a. Provide Our Services;

b. Enforce Our Terms of Use for Our Website and this Policy;

c. Notify You about any changes in Services;

d. Fulfill Our legal obligations to Users;

e: Fulfill Our legal obligations and respond to any litigation or law enforcement/government inquiry;

f. Insure that Our Website, products and Services are presented to You in the most efficient manner for You and Us;

10. Changes to this Privacy Policy

We may change how we collect and use Personal Information at any time and without prior notice, at our sole discretion. We may change this Privacy Policy at any time. If we make material changes to the Privacy Policy, we will notify You either by posting the changed Privacy Policy on the Website or by sending an email to You. We will also update the “Last Updated” date at the top of this Privacy Policy. If we let You know of changes through an email communication, then the date on which we send the email will be deemed to be the date of Your receipt of that email.

 It is important that You review the changed Privacy Policy. If You do not wish to agree to the changed Privacy Policy, then We will not be able to continue providing the Website and Our Services to You, and Your only option will be to stop accessing the Website and Our Services and cancel Your account. 

11. Laws in Other Countries 

We comply with United Kingdom privacy laws and regulations. We do not represent the Website is governed by, or operated in accordance with, the laws of other nations or jurisdictions, or that the Website or any portion of it is appropriate or available for use in any particular location. If You choose to access the Website, You do so at Your own risk, and You are responsible for complying with all local laws, rules and regulations. By using the Website, visitors to it from outside the United Kingdom acknowledge and agree that Our Website is subject to United Kingdom laws and regulations only, and waive any claims against Us that may arise under their own national laws.
